If a person acts negligently, but doesn’t hurt anyone, they will likely not be held legally liable for their negligence. However, if a negligent person/party does cause an accident or injury, they can be held accountable. For example, if the texting driver rear-ends another motorist, causing serious injuries, the injured driver can sue the texting driver for damages.
