ELEMENTS OF A PERSONAL INJURY CLAIM
Before filing a personal injury claim in New York, you must prove the following elements:

Duty of Care
You must first establish that the other person/party owed you a duty of care. This means that the other person/party had a legal duty to act within reason to prevent you from coming to undue harm. For example, drivers have a legal responsibility to follow the law and prevent accidents whenever possible. Drivers who act negligently, such as by texting while driving, can be held responsible when their negligence causes accidents that injure others.

Breach of the Duty of CareYou must be able to prove that the person/party that owed you a duty of care breached that duty of care. Typically, this is done by proving that the other person/party was negligent or acted unlawfully in some way. To continue with the above example, a texting driver is both negligent and acting unlawfully, as texting while driving in New York is illegal.

CausationYou also have to prove that the breach of the duty of care was the proximate cause of your injuries. If a person acts negligently, but doesn’t hurt anyone, they will likely not be held legally liable for their negligence. However, if a negligent person/party does cause an accident or injury, they can be held accountable. For example, if the texting driver rear-ends another motorist, causing serious injuries, the injured driver can sue the texting driver for damages.
